Jim is a rare native species.<\/p>\n\n\n\n<p>Now he is trying to raise money to appeal a very important property rights case to the United States Supreme Court. Buffalo Bayou flows between the forest of Memorial Park on the right and the River Oaks Country Club on the left.<\/figcaption><\/figure><\/div>\n\n\n\n<p><strong>The Issue<\/strong><\/p>\n\n\n\n<p>Recently the University of Houston Bauer College of Business<a href=\"https:\/\/www.gofundme.com\/f\/texas-sovereign-immunity-copyright-theft-scotus?member=12599637&amp;sharetype=teams&amp;utm_campaign=p_na+share-sheet&amp;utm_medium=email&amp;utm_source=customer\" target=\"_blank\" rel=\"noreferrer noopener\">, in an ugly teachable moment, won a case in the Texas Supreme Court,<\/a> claiming that they can just take and use without any compensation or even any credit the copyrighted work of a photographer (among other copyrighted property).<\/p>\n\n\n\n<p>Jim\u2019s legal team had won in state district court. Three years ago <a href=\"http:\/\/digital.olivesoftware.com\/Olive\/ODN\/HoustonChronicle\/shared\/ShowArticle.aspx?doc=HHC%2F2018%2F06%2F15&amp;entity=Ar01703&amp;sk=78E1BBC7&amp;mode=text\" target=\"_blank\" rel=\"noreferrer noopener\">State District Court Judge Caroline E. Baker held<\/a> that the Texas Constitution prohibits governmental agencies from taking private property without adequate compensation.<\/p>\n\n\n\n<p>But the school appealed and the state court of appeals reversed that decision. And in June the state supreme court agreed that the State of Texas and its institutions have \u201csovereign immunity.\u201d They can\u2019t be sued. The university can use Jim\u2019s copyrighted materials for three years without paying a dime in compensation.<\/p>\n\n\n\n<p>The University of Houston could have paid Jim a fair market price for using his work. Instead they decided to steal it and generate a lot of bad publicity for themselves.<\/p>\n\n\n\n<p>Jim is appealing this decision to the United States Supreme Court. It\u2019s an important case. But the appeal costs money. Jim is trying to raise at least $20,000 to pay for it. They\u2019ve involved not only the theft of copyright, but also of patents and trademarks.
